Section 39 Documentation

Section 39 documentation relates to Non-Acute/Community Agencies being provided with funding under Section 39 of the Health Act, 2004. This relates to all agencies with the exception of the 39 agencies funded under Section 38. The Framework allows for a tiered approach to the level of governance and separate documentation is used for agencies in receipt of funding above/below €250,000.

Chairpersons Statement (SAMPLE)

Under the Grant Aid Agreement organisations are required to return a Chairperson's Statement to the HSE.  Where organisations do not have an internal format for this, they should use this standard proforma document.  Organisations should ensure the elements covered in this proforma are covered in any internal reports submitted.

Principal Updates document - S39 ACS 2020 v 2019

This Annual Compliance Statement (ACS) document is required to be submitted to the HSE Compliance Unit on an annual basis by Section 39 agencies that are in receipt of over €3 Million in a year and relates to compliance with corporate governance requirements for the prior year

Each year the ACS document is reviewed, and revised as appropriate. Thereafter, the updated document is circulated by the HSE Compliance Unit to the relevant Section 39 agencies
